<br />August 7, 2007 <br />The Mooresville Town Council met in regular session an August 7, 2007 at 6:30 p.m. at <br />the Mooresville Government Center. <br />Council members present were: President, Tam Worthen and Councilmen Toby Dolen, <br />John L. Clark and Mark Harris. Councilman Eric Shields was absent. Town Attorney, <br />Tim Currens was present. <br />Maureen Shae, of St. Thomas Mare, gave the opening prayer. <br />A motion to approve the minutes of the July 17, 2007 meeting was made by Councilman <br />Clark with a second by Councilman Dolen. Motion carried 4-0. <br />The first item on the agenda was the Public Hearing for the additional appropriation of <br />$300,000.00 from the LR&S fund for paving. <br />There being na public comment either for or against the additional appropriation, a <br />motion to approve Resolution 10-2007 for the additional appropriation of $300,000.00 <br />out of LR&S for paving was made by Councilman Clark, second by Councilman Hams <br />and carried 4-0. <br />Gregg ~rf, of L & I Risk Management Group presented the Council with information on <br />a service his company offers to train employees on identity theft prevention. He <br />explained that the Town could be fined if an employee releases confidential information. <br />They would not charge for the employee training. They also offer policies which would <br />prateot employees if their identity was stolen. This would be an option to employees to <br />purchase this type ofpolicy through payroll deduction. President Worthen recommended <br />that the Council table this matter until they could talk to the individual department heads. <br />A motion to table the discussion of the proposed services by L & I Risk Management <br />Group was made by Councilman Hams and second by Councilman Clark. Motion <br />carried 4-0. <br />Under unfinished business, President Worthen stated that the Town had received the <br />preliminary draft report from Christopher Burke Engineering on the Springmill Drive <br />drainage issue. A copy was given to all of the Council members. President Worthen <br />stated that he was somewhat disappointed with the lack of answers given in the letter. He <br />had spoken to Kerry Daily at Christopher Burke Engineering and was assured that this <br />was only a starting point. He had also spoken to Judy Atwood who lives at 721 <br />Springmill Drive, and asked what questions the homeowners would like to have <br />answered. Judy Atwood was present at the meeting along with several other area <br />residents. Judy Atwood expressed similar disappointment in the letter. She felt that <br />when the original drainage report information could not be found that someone should <br />have been contacted. President Worthen stated that the letter provides effects, which we <br />already know. We need to know causes. He would like to see Topo maps of the <br />preconstruction property. He has been told that the swale has changed but that is <br />uncertified information. Christopher Burke Engineering has stated that they have not <br />found any Topo maps that are certified. Tom Worthen stated that he had asked for pre <br />and post construction flows and the letter only gives past construction flows. He feels <br />that there should be either no change or a reduction in the flow. Kerry Daily will come <br />to the drainage board meeting. Judy Atwood will ask her contact at Aegis Environmental <br />if he would mind if Christopher Burke contacted him to find out where he got the <br />drainage information that he provided to her. Gary Priest, who lives at 761 Springmill <br />Drive presented the Council with a letter regarding the erosion of his property and the <br />forming of a ditch in his back yard that he says began after the development of the <br />property to the south of him. He has spoken to Kerry Daily and explained to him that the <br />ditch was not there when he built his house in 1989. He stated that Kerry Daily said he <br />didn't know that the elevation of the land behind him had been changed. President <br />Worthen stated that he would get with Judy Atwood and Gary Priest and submit their <br />questions in writing to Christopher Burke to request more information. <br />
