~~'~ <br />October 2, 2007 <br />The Mooresville Town Council met in regular session on October 2, 2007 at 6:30 p.m. at the <br />Mooresville Government Center.. <br />Council members present were: President, Tom Worthen and Councilmen Toby Dolen and John <br />L. Clark. Councilmen Eric Shields and Mark Harris were absent. Town Attorney, Tim Currens <br />was also present. <br />The meeting was opened with prayer. <br />A motion to approve the minutes of the September 18, 2007 meeting was made by Councilman <br />Clark, second by Councilman Dolen. Motion carried 3-0. <br />Judy Atwood of 721 Springmill Drive was present to ask the Council some more questions <br />regarding the Springmill drainage issue and some answers she was previously given. She <br />wanted to know where the swale is that is supposed to run between Rooker Run and Springmill. <br />She stated that she cannot find one. She also wanted to know what happens to the drainage from <br />Boyd Heights. <br />Brian Haggard of Banning Engineering was present to report his findings from his site evaluation <br />at Springmill Drive. He presented the Council with a handout explaining his findings that <br />included pictures of the area. Mr. Haggard had observed the area during rain on Wednesday, <br />September 19~~', at which time he stated in his report that the only flow visible on the east side of <br />Rooker Road was from the detention basin outlet and no flaw was observed within the ravine to <br />the north. The report states that a higher intensity storm maybe needed to occur to identify what <br />types of rain events cause additional flows through the ravine and into the 24" pipe under Rooker <br />Road. The report also states that the ditch behind the homes on Springmill seems to follow the <br />path suggested in the June 1990 Springmill Subdivision construction plans, which call far the <br />existing ditch line not to be disturbed behind home #1 through home #S. His report also states <br />that when you find erosion as deep and wide as seen in this ditch, combined with the amount of <br />runoff from upstream developments, it suggests that the soil maybe sandy. Possible solutions <br />suggested in the report, which would require the ditch to be cleared of trees and vegetation, <br />include Rip-Rap 8 - 12" size with geatextile, Green Armor or other type of Bio-Engineering, and <br />the re-planting of native herbaceous and woody species to re-establish the wooded corridor feel. <br />Mr. Haggard also stated that if there was work to be done, the shed behind home #5 might have <br />to be moved. Judy Atwood was given a copy of the report. Brian Haggard stated the he would <br />be available for phone calls to answer any questions. Attorney, Tim Currens stated that he had <br />heard back from Dale Coons of Dominion and he is still looking for things that are in storage. <br />The next item an the agenda was the Cemetery. President Worthen had asked the Cemetery <br />Sexton, Ed Bucker to attend the meeting to discuss the plotting of the new section of the <br />cemetery to allow for lots in that section to be sold. During a conversation between President <br />Worthen and Ed Bucker back in August, Ed had stated that the lots would be ready to sell by the <br />end of September. However, in late September, Mr. Bucker told Mr. Worthen that the lots were <br />not ready and he believed that they needed to have the South boundary surveyed and marked. <br />During the meeting, Mr. Bucker stated that he had wanted to mark the lots himself due to <br />problems in the past when a section was marked off by an engineer; however he was not able to <br />complete it by the end of September due to the fact that lately, his normal cemetery duties had <br />required more time than usual and the extra work on this project was causing his personal <br />monument business to suffer. President Worthen asked Brian Haggard if Banning Engineering <br />would mark off cemetery lots. He stated they could if someone showed them what needed to be <br />done. President Worthen asked the Council if they could move forward by giving him authority <br />to enter into an agreement with an engineering company and they either begin work without an <br />agreement or he will bring an agreement back to the next meeting. President Worthen asked Ed <br />Bucker to make himself available to the engineers when they begin the work. <br />A motion allowing President Worthen to enter into an agreement with an engineering company <br />to begin marking off the cemetery lots was made by Councilman Clark, second by Councilman <br />Dolen. Motion carried 3-0. <br />Under Legal, Attorney, Tim Currens presented the Council with an interlocal agreement on the <br />Community Planning Grant. Councilman Harris had agreed to be a representative for the Town <br />and he, Charles McGuire and Darrell Brown had attended a meeting in Martinsville on Friday, <br />
