Mitzi Forbes lives on Main Street but told the council she walks the tree lined <br />streets and hated to see the trees removed. She said the council should talk to someone <br />and ask what trees needed to come down. It looked like eleven had been removed. Town <br />attorney Tim Currens said some were stump removals and told her the council had talked <br />with knowledgeable people concex~txing the replanting of the trees. Mitzi emphasized to <br />the council to please use caution on their projects. Tam Redman asked if there was an <br />easement up to the sidewalk. The Town's easement is to home side of sidewalk, so Town <br />owns the property from the home side of sidewalk to the street. Bill Overholser, Morgan <br />Street, said he had lived in Mooresville for 30 years. He thought the introductory <br />statement Council President Mr. Worthen gave was very good. He said urban sprawl <br />does not have trees. It takes 70 years far some of those trees to be replenished. He <br />wanted a philosophical statement an how the council planned to handle the trees. He <br />thought the people at the video store across from new Government Center had done a <br />good job by taking the curb out around the tree. Steve Ballard, East Harrison Street, told <br />the council that a long time ago his trees in front of house died. ,The Street Department <br />got rid of the trees and he had gotten new sidewalk and gravel parking put in. He is <br />afraid he will lose this extra narking. His work truck is so huge he parks it in back and his <br />family and friends park in front of his home. His truck is considered too wide and <br />obstructs traffic. He said the parallel parking outside the new Government Center was a <br />traffic hazard because traffic is obstructed. Ann Whaley, East Washington Street, told <br />the council everyone had good points and asked if existing funds will be used for this <br />project this year. Council President Worthen said we are going to suggest this plan goes <br />on year to year. Ann was concerned the people an the other streets will not continue and <br />said she believed everyone who lives in Town needs to take responsibility on what goes <br />on in the Town. She doe not think anyone wants to see a good tree cut down. Steve <br />Edwards said he had been satisfied, but the council had, slipped up. He wants them to go <br />around the pretty trees. Councilman Bryant said the planting strips are 5 to 6 foot wide. <br />A sidewalk was replaced five years ago and a bow was put in around a tree at Edwards. <br />To leave the five trees in place they would be damaging sidewalks and damaging <br />infrastructure they had just put in place. <br />Next, Cheryl Kline, Roberson Woods, requested permission to have a block party on <br />September l6a' , in the afternoon. They are requesting barricades from Street Department <br />but they are not going to block any driveways. A motion was made by Councilman <br />Dalen, with a second by Councilman Shields to approve block party beginning at 4 PM. <br />Motion carried 4-0. <br />Town attorney Tim Currens presented a quote For A & A Transmission, Allison Road, for <br />Developer Availability Agreement for offsite and over sizing only. The job has been bid <br />out. A motion was made by Councilman Bryant with a second to approve the agreement <br />solely on the lowest bid. Motion carried 4-0. <br />Next the council discussed EBI letter for Nextel Sprint tower located in area of Street Salt <br />Barn.. Attorney Cuttens will make sure the prints are correct and they are putting it in the <br />right place. Motion was made by Councilman Shields with a second by Councilman <br />Dolen to obtain more information and table to September S, 2006 meeting. Motion <br />carried 4-0. <br />Dog Ordinance: Councilman Bryant asked if there were any restrictions as to number of <br />dogs in a yard. Animal Control Off cer, Mark Taylor, said the limit is 5. Joe Beikman, <br />Street Superintendent said can have over 5 as long as zoned properly. Fees are set <br />throughout the ordinance and ordinance reads S dogs and/or 5 cats total not to exceed S. <br />Councilman Bryant asked if the limit could be lowered to 2. Mark Taylor thought there <br />would be lots of complaints on lowering the number. Dogs' barking all night is addressed <br />in the ordinance. Council President Worthen questioned Sec. 4 Item K $50,000 fine. <br />Town Judge Susan Leib thought $50,000 might not be enough. She said if a dog has <br />mangled anyone minding their own business walking down a sidewalk, she would <br />impose a lot of fines on the owner. A motion was made by Councilman Shields, with a <br />second by Councilman Bryant to table. Motion carried 4-0. <br />Council President Tam Worthen reported to the council the Redevelopment Commission <br />agreed to pay up to 27% of fees associated with WWTP rate study by Umbaugh if an <br />agreement is entered into.
