A motion was made by <br />Councilman Bryant with a second by Councilman Dolen to approve the agreement with <br />Town portion paid from WWTP Plant Improvement Fund and 27% being paid by <br />Redevelopment Commission TIF funds. Motion carried 4-0. <br />Council President Worthen told the council that currently on duty injuries are treated <br />differently for civilians than Police and Fire: The Police anal Fire have the 77 Pension <br />Fund and civilians have workers compensation. With the 77 Police & Fire Pension, if a <br />disability is approved the benefit begins after exhaustion of all paid leave (vacation, sick <br />or holiday). Councilman Shields reported the workman's comp pays the medical portion <br />only for Police and Fire. Civilians are covered under a fully insured plan, medical and <br />time off. He asked attorney Currens if we were required bylaw to provide workman's <br />comp. Attorney Currens answered no, workman's comp is only related to job injury. <br />Councilman Shields said he preferred workman's comp for everyone. Council President <br />Worthen said a full benefits package for worker's comp is $9,089.00 a year and asked if <br />we could make it that our police and fire sick, vacation, and holiday time could not be <br />used for injury on the job. Attorney Currens said he didn't think so. This would be <br />attempting to put our community before all other communities. The 77 Pension rule is <br />far all communities. Police Commissioner Berwick asked if a police or firefighter is <br />injured on duty shouldn't they not suffer any financial problems. A discussion was held <br />concerning sick days not being paid off when they retire, 66% pay while injured was <br />based on non taxed income, should deductions be on check, etc. Police Commissioner <br />Berwick asked why they couldn't continue to get paid anal then turn aver their workman's <br />comp check to Clerk-Treasurer. Jae Beikman said if you have them turn over their <br />workman's comp pay and 2.5 days per day and keep pay the same it is a wash. <br />Councilman Shields said he was not going to vary. It is fiill pay injured on duty and it is <br />their responsibility to get back to work as soon as possible. Councilman Bryant asked <br />what if a second opinion is not agreeable with the first. Mark Taylor said he has to go <br />thru employee health and reports back to them an a weekly basis to see when to go back <br />to work. Councilman Shields said you have to have an end point to it. He thinks 77 <br />Pension is a permanent disability. Councilman Bryant said he was curious as to how long <br />full amount is paid and 66% is turned aver to the Town. Council President Worthen <br />asked what the council wanted to da. He said they could see if State automatically limits <br />the time. Councilman Bryant said he would like to know the time frame, he was pretty <br />well OK with turning over workman's comp check far work related injuries far civilians, <br />fire, and police all being treated the same. Attorney Currens told the council they could <br />set their own time frame of number of days going to be paid full salary. He will get a <br />time frame from workman's comp. Mark Taylor asked if workman's camp counted for <br />full time or part time or both. Council President told him the council would get a copy of <br />workman's comp policy and Mr. Currens would find out what maximum time it would <br />pay and for whom. <br />The council turned to budget reviews: Judge Susan Leib reported the court was not going <br />to fund itself as much for 2007 as in the past. They are losing fax fees for Fax Fee Fund. <br />The council went thru line items moving equipment repair amount of $3,500 into office <br />supplies making tliat a total of $8,500. <br />Next, the MVH budget was reviewed by line item. Joe Beikman told the council salt was <br />going up from $42.00 to $55.00. Attorney Tim Cunrens told the council they had to bid <br />all paving together, they couldn't just bid two streets. Council President asked Joe what a <br />conservative amount for paving would be and Joe Beikman answered $200,000 to <br />$250,000. The Council then reviewed and discussed the Utility Dept., Storm Water, and <br />Town Hall budgets. <br />Animal Control Off eer, Mark Taylor, reported twenty nine (29) calls, eleven (11) <br />impounds, and seven (7) returned. <br />Council President Worthen read a letter from the Lions Club defining their agreement <br />with the Town to contribute $60,000 towards the renovation of the Meeting Room and <br />Kitchen in the Town Government Center. The Lions Club spent a fatal of $9,335.58 for <br />furniture, appliances, steam table, paint and other supplies. Included with letter was a <br />check for the difference in the amount of $50,664.42 to the Town. <br />
