Perry, Clerk-Treasurer <br />1 <br />September S, 2006 <br />The Mooresville Town Council met in regular session on Tuesday, September 5, 2006, at <br />6:30 P. M. at the Government Center.. <br />Council members present: President Tom Worthen, Jahn L. Clark, Troy Bryant, and <br />Toby Dolen. Council member Eric Shields was not present. Town attorney Tim Currens <br />was present. <br />Prayer was given by Tom Worthen. <br />A motion was made by Councilman Clark with a second by Councilman Dolen to <br />approve minutes of 8-15-2006 and 8-18-2006 meetings. Motion carried ~-0. <br />The owner of Zydecos requested penx~ission to put up an awzung and wrought iron in <br />front of their business located on East Main Street. This is to try to cut the wind coming <br />into the building. There will be five feet two inches of sidewalk still left in front of <br />building. They wish to have two tables for people to eat. They have talked to Alcohol <br />Beverage Commission and this is o. k. There will be four seven feet two inch posts from <br />base of the building and they will use rope to connect the posts because they need <br />something removable plus there is an awning they can put up or down. Building <br />Inspector Joe Beikman commented they would probably need to file for a variance.. They <br />could have a letter frozx~ the Town Council to the Board of Zoning Appeals. The posts <br />will be bolted into the cement. A motion was made by Councilman Clark with a second <br />by Councilman Bryant to allow permission to add an awning and posts provided they get <br />a variance from the Board of Zoning Appeals. Motion carried 3-1 with Council President <br />Worthen opposed. <br />Randy Windhorst, Holloway Engineering, presented a rezone for A & A Transmission on <br />Allison Raad from Agriculture to I-1. The Flan Commission had given a favorable <br />recommendation to the council. Councilman Bryant reported the thoughts of the Flan <br />Commission was this rezone matched the zoning there.' A motion was made by <br />Councilman Clark with a second by Councilman Dalen to approve Ordinance 6, 2006. <br />Motion carried ~-0. <br />A motion was made by Councilman Bryant with a second by Councilman Clark to <br />approve a developer availability agreement with A & A Transmission. Motion carried 4- <br />0. <br />Randy Windhorst, Holloway Engineering, presented another rezone for Karen Overpeck <br />from agriculture to B-3. This property is adjacent to Meadow Lake. Plan Commission <br />gave a favorable recommendation to the council. They will be back to Plan Commission <br />when the business lots are to be built on. The business lots will have their own entrance. <br />A motion was made by Councilman Bryant with a second by Councilman Clark to <br />approve Ordinance #7, 2006. Motion carried 4-0. <br />
