ss~ <br />A motion was made by Councilman Clark, with a second by Councilman Shields to <br />approve the minutes of March 2, 2004. Motion carried 5-0. <br />First on the agenda was Ray Young Subdivision. Council President Warthen asked if <br />there were any questions. One question asked was, if I pay my $900 hook on .fee how do <br />I know when the sewer will be done? Answer: The fee will be requested after <br />infrastnrcture is in place. Another question, who came up with the price of $900? <br />Attorney Tim. Currens answered: An actuarial was done to calculate a fair price for each <br />person and was in a Sewer Ordinance of 1984. Any vacant lots will need to pay $1100 <br />more. <br />Mr. Mudd gave a petition to President Warthen to cross check with the letters chat were <br />received. Mr. Mudd's list included two undecided and three opposed. There were two <br />.houses IVIr. Mudd had .not been able to locate the owners. The council decided to poll <br />those that were undecided to see i:f there was a question that needed cleared up. Mr. <br />Chapman was not present. Mr. Carson was present and his question was where the sewer <br />was going to be installed.l-le wants the sewer line to go between two houses and not <br />down the middle of the street. The consensus of the council was that engineering would <br />have to be done .before an answer could be given and the council would take the cheaper <br />bid. Councilman BryanC told the audience the costs would be Towns regardless of where <br />or how the sewer goes. <br />Of the three homeowners that were opposed only Mr. Hopkins was present and hi.s reason <br />for being opposed was because his septic worked fne. Mr. Grounds and Mr_ Bolton were <br />not present. <br />Mr. Carson told the council that gas and water lirres were in front of the houses which he <br />thought presented a problem with going down the street and he said a lot of the people <br />thought they were going to get rid of water but will only get rid of sewage. <br />Mr. Mudd said there were two homeowners they had not been able to contact. A <br />mortgage company owns one home and Mrs. Asher gave Tim Cunens the name of the <br />company to contact. <br />Councilmani Bryant said. there were two issues. One issue was annexation, because it is <br />not completely voluntary artd the other issue was contiguity (two homes that front Hadley <br />Road) <br />Attorney Currens said the Town of Mooresv,ille had never done a forced annexation <br />befora. Councilrtatm Bryant said he needed more iz~l'ormation on :forced annexation and <br />he would go door to door on those he needs to talk to, the undecided, the against, and the <br />two vacant homes. <br />Mr. Hopkins seemed not to have a problem with annexation. He just did not want to <br />.hook ozi now and would be agreeable if he could hook on when his septic fails. <br />The Ray Young addition will be on the agenda for the Apri120''' "Gown Council meeting. <br />Next on the agenda was Dennis Collier requesting a rezone for 104 E. High Street to a B- <br />2 to operate a hair salon. 'Cher-e was a variance under the previous owner to operate a <br />beauty shop. Councilman Bryant had a question about access off of High Street. Mr. <br />Collier said there was and they plan to add more parking. This request came from the <br />Plan Commissiott with a favorable recommendation. A motion was made by Councilman <br />Clark and a second by Councilman Dorn to approve Ordinance #4, 2004 to rezone from <br />R-1 to B-2. Motion carxied 5-0. Councilman. Bryant would rather see access back to <br />grass or pavement. <br />Mr. Holloway presented a request for Value Plus Pharmacy and the old IGA to rezone <br />fi-oztr B-Z to B-3. Council President "Cor1r Worthen said they wanted to get in compliance <br />with the Town zoning book. A rnotion was made by Councilman Doles acid a second by <br />Councilman Clark to approve Ordinance 5, 2004 to rezone to B~3 with restrictions of no <br />nightclubs, team club, kennel, or tavern. Motion carried 5-0. Tl~e Plan Commission had <br />given a favorable recommendation to the Town Council. <br />
