ss~ <br />The Storm Water Ordinance and Fees approval is scheduled for <br />April 20, 2004 meeting and the Storm Water Design Manual <br />approval is set for the first council meeting in May. <br />Attorney Tim Currens told the council the Plan Commission had <br />approved the changes the Town Council had requested to the <br />Comprehensive Plan unanimously. The council now needs to approve <br />the entire Comprehensive Plan. <br />Councilman Bryant read the changes to the council. A motion was <br />made by Councilman Bryant with a second by Councilman Clark to <br />approve the entire Comprehensive Plan. Motion carried 5-0. <br />A motion was made. by Councilman Clark with a second by Councilman <br />Shields to approve Ordinance #7, 2004 vacating the right-of-way <br />on Old St. Rd. 67 by Foe's Cafeteria at the request of Jeff Cave. <br />Motion carried 4-1 with Councilman Bryant opposed, <br />Next was the remonstrance hearing for the Award of Damages. <br />Attorney Currens stated that Mr. Turner, the owner of the property <br />at 39 West Main Street, may present this in writing to the <br />council. Mr. Turner happened to be present at the meeting and <br />told the council the property had been assessed at $52,500 and he <br />felt like this should be the starting price far the property. <br />He said the appriasal he was getting had not come back yet, <br />The Town had two commercial appraisals done and both had come <br />been $39,000. Councilman Bryant asked if the Town was locked <br />in to this price. Attorney Currens answered generally, but <br />in this case you have a little more fle~cibility. Councilman <br />Bryant figured the difference between the two amounts as being <br />$13,500 and stated he was not opposed to splitting the difference <br />bringing the price to $45,750.00 <br />Mr. Turner said this might be a possibility. He will speak to the <br />other Trustee. <br />o y <br />1. sustain or modify the award <br />2. Continue this hearing to the April 20, 2004 meeting. <br />Att me Currens told the council they had two options: <br />Process--if remonstrator is agrieved by the reward there is 20 <br />days to appeal, to a court in Martinsville for a <br />Damages Hearing from both sides. ' ~~ <br />Councilman Clark and Councilman Dolen wanted to offer $45,750 <br />now and be finished with the process. <br />Attorney Tim Currens suggested the council continue this hearing <br />to the April 20, 2004 meeting to"see if the Trustees agreed <br />to the price of $45,750. <br />A motion was made by Councilman Bryant, a second .from Councilman <br />Clark to continue the hearing to April 20, 2004 to see what <br />decision the Trustees make on the price of $45,750. <br />A motion was made by Councilman Bryant with a second from <br />Councilman Clark to approve the documents for Hippo Security Law <br />and bring us into compliance with the Federal Mandate. Motion <br />carried 5-0. <br />Council President Worthen told the council he wanted to pursue <br />options and the best plan for combining Brawn Township Fire <br />Department and the Mooresville Fire Department. C.auncilman <br />Clark stated he would only vote for this if Mooresville was <br />in control of the whole department. <br />Mark Taylor, Animal Control Officex, reported twenty six (2Fi) <br />calls, seven (7) impounds, and three (3) returns. <br />A motion was made by Councilman Clark with a second by Councilman <br />Dvlen to approve payment of the claims. Motion carried 5--0. <br />ri <br />r <br />Councilman Bryant asked if the Redevelopment Commission vacancy <br />was a council appointment as a whole and if it was a process <br />needed to be set to fill the vacancy. <br />
