7~~ <br />Police Commissioner Dean Kays reported to the council the two new officers Crist and <br />Richart had been assigned to the late shift. Also that John Forbes, the Lt. On the third <br />shift, has been called to active duty for one and one-half years. <br />Jae Beikman announced leaf pick-up would begin on October 11, 2004. <br />Animal Control Officer Mark Taylor reported twenty-one (21) calls, four (4) impounds, <br />and one (1) return. <br />Councilman Shields made a motion to approve payment of the claims. Councilman <br />Dolen seconded the motion. Motion carried 4-0. <br />There being no further business to came before the council at this time a motion was <br />made by Councilman Dolen with a second by Councilman Bryant to adjourn the meeting. <br />Motion carried unanimously. <br />ATTEST: /~ <br />Sandra R. Fe ,Clerk-Treasure <br />~' <br />'~^ <br />Tom Wart ,President <br />October 19, 2004 <br />The Mooresville Town Council met in regular session on Tuesday, October 19, 2004, at <br />6:30 P. M. at the Mooresville Town Ha11. <br />Council members present were: President Tom Worthen, Troy Bryant, Jahn L. Clazk, <br />Toby Dolen, and Eric Shields. No members were absent. Town attorney Tim Currens <br />was present. <br />Jeff Newton from the Free Methodist Church gave the prayer. <br />A motion was made by Councilman Clark with a second from Councilman Bryant to <br />approve the minutes of October 5`~, 2004 with corrections East High to East Main Street <br />and 37 to 39 West Main Street. Motion carried 5-0. <br />A motion was made by Councilman Dolen with a second by Councilman Clark to <br />approve Declaratory Resolution #20, 2004, for a three year tax abatement for Prodigy <br />Group and to advertise far a Fublic Hearing at the November 2, 2004 Town Council <br />meeting. Motion cattied 5-0. <br />Mike Arp, 147 E. Carlisle Street, appeared before the council to ask what could be done <br />about the parking ordinance #5, 2003. He owns two trucks that are Dueleys and he <br />cannot pazk them on any street in the Tawn of Mooresville because the parking ordinance <br />states that no vehicles over 82 inches wide could park on the street and ono vans over 7 <br />feet tall. Mr. Arp said that means he could not park on the street and eat at Zydecos. He <br />feels like Dueleys and Hi-Top Vans are being discriminated against. Mr. Arp said his <br />Dueleys measured 95.5 inches if it is parked tight to the curb, this is allowing for the 12 <br />inch from the curb variance. Attorney Currens said you couldn't assume everyone is <br />going to park close to the curb. This ordinance was based on health and safety issues and <br />you have to draw a line at same point. Discrimination was not an issue. Mr. Arp said <br />when this ordinance was started the specifics was to keep dump trucks, trailers, and semi <br />tractors off the street. Mr. Currens said that wasn't entirely correct, they were looking at <br />width of vehicles, and the impact it would have on pazking, and the ability for traffic flow <br />in emergency situations. Councilman Bryant said these were things he wanted in an <br />ordinance. It came down to the best way to address restrictions was to ga with <br />dimensions. I did not even realize we had set up an ordinance that was going to exclude <br />Dueleys. Councilman Worthen and I discussed this and it came back to a width we were <br />going to stay with in the ordinance. You can really select certain streets you will allow <br />bigger vehicles and street that are restricted you are going to have signs all over Town. <br />1 <br />~1 <br />1 <br />
