~~ <br />Dean Mayfield, Mayfield Insurance, appeared before the council to explain he needed an <br />easement for the old Labco Building 50 South Madison (he has purchased) because part <br />of his building sits on the Town'sright-of--way. The building was built in the 1920's and <br />attorney Tim Currens said that in the older section of Town surveys were not that. <br />accurate and this happens quite frequently, but the Title Insurance Company wants <br />something in writing that this is not a problem. A motion was made by Councilman <br />Clark, seconded by Councilman Bryant to pass Resolution #6, 2003, to issue an easement <br />for the encroachment of part of the building. Motion passed 4-0, Councilman Mathis <br />abstained. <br />Mr. Mayfield also asked for a yellow pedestrian walkway from the building to across the <br />street for the parking lot. He also requested afour---way stop sign at the intersection <br />where there is currently atwo-way stop. He said he understood this used to be a four- <br />way stop years agv. A motion was made by Councilman Worthen, seconded by <br />Councilman Clark to do a traffic study thru the Police Dept. and the Street Department. <br />Motion carried 5-0. <br />Parking Qrdinance Discussion: President Dolen told the council members he was not <br />ready to do anything on the ordinance yet, he wished to study the ordinance fi~ixther. <br />Councilman Worthen asked Tim Currens if he had thought of another way to word the <br />part about utility trailers pazked on the street other than providing service for a residence. <br />Town attorney Tim Currens said do you mean like a~ person's own trailer. Councilman <br />Worthen said yes. Attorney Cuzxens said he did reword this to address what Councilman <br />Worthen had suggested. He went on to say that in other things in this ordinance the <br />width, length, and height, no matter whether a truck, trailer, boat, etc. A length of 25 feet <br />or greater, width 82 inches or greater, and a height of 7 foot or greater and tlv.s ordinance <br />was drafted fpr the council's review. He said this was how he addressed this in the <br />ordinance, a car, truck, trailer, boat all within this definition. Councilman Bryant asked, <br />regardless of size ? Attorney Currens said yes to this extent under Section 4, if the size <br />met that criteria it is not to be pazked an the street. Councilman Bryant said what if it <br />was a small utility trailer and Tim Currens said then it would not fall within that criteria. <br />Councilman Bryant said he would like to have the wording changed to say any trailer not <br />allowed to park on the street regardless of size. Councilman Clark told Councilman <br />Bryant if there were too many restrictions, no one would live in Mooresville they would <br />move out into the county. Counciln~w Bryant said they could still park their cars on the <br />street, their trucks and their full size vans. Councilman Clark said a lot of trucks are now <br />7 foot tall and most trailers parked on streets in town are small, 5 by 7, and if it has a <br />plate on it, it's parked legally and there is nothing you can do about it. Councilman <br />Bryant said that is why we are taking a look at this now. Councilman Clark said this will <br />not work. Councilman Bryant said, well, why wouldn't it work? Councilman Clark said <br />he would not vote for the ordinance written as such because it was putting too many <br />restrictions on the people of the Town. If you can't have usage of the property in front of <br />your house, then what is the use of living in Town? Councilman Bryant said it is just the <br />large vehicles and the trailers. Councilman Clark said he still would not vote for it. <br />Councilman Clark said he could see no parking of semis within an addition, he said <br />anything over 11,000 pounds should not be pazked in the addition. Presideat Dolen said <br />we will study this further. Councilman Worthen asked about the height of 7 feet. <br />Councilman Clark said this should be changed too. Attorney Tim Currens said these <br />figures were came up with when they took some measurements of vehicles. He said <br />probably the antenna should be excluded. President Dolen said you might have luggage <br />racks or ladder racks too. Attorney Tim Currens said that the vehicles we drive today are <br />
