Taryn and Ernie Powell residing at 137, 1371/2, and 139 Bridge Street appeared before the <br /> council with a problem concerning Goose Creek. They live right behind Quest Orthodontist. <br /> The drainage ditch goes beside Quest and curves around by them but the ditch is not wide <br /> enough for flow of water in places where the ditch is only 6 inches deep and twelve inches wide. <br /> It is not wide enough for big flows of water. They wanted to know if the Town would consider <br /> making it deeper. Jeff Allen said he was having some issues downstream from this on the same <br /> creek. Mr. Powell has had to replace a floor and a wall in his house due to water not able to get <br /> down the creek. Morgan. County told them that Goose Creek was Town property. Mr. Currens <br /> said he would be glad to walk the creek with them to see the problem areas. Further <br /> investigation has to be completed. <br /> Chris Gale, HNTB,presented change orders and liquidated damages. The change order was for <br /> a total of$25,552.72. Items 3, 315, the tank needed repair,removal of valves and pipes and the <br /> concrete had to be chipped away which took additional time and coating was required. Items 2 <br /> &4 in the amount of$6,341.74 related to the UV system, when hooked up problems with ballast <br /> and circuit board. A neutral wire was never landed from 2005 and#4 was items burnt up. <br /> HNTB will reimburse the Town$14,377.00. if they had known about the land wire it would <br /> have been included,but it needs to get to a four wire system because it will be a benefit to the <br /> next phase. Liquidated damages have not been negotiated or discussed yet. Attorney Currens <br /> and Chris Gale will talk this week. A lot of rain has delayed the project. <br /> A motion was made by Councilman Clark with a second by Councilman Cook to approve pay <br /> request#6 from Thienemen Construction for$172,120.00. Motion carried 4-0. <br /> Joe Beikman, Street Department, had quotes on Streetlights in Brookmore Addition. To install <br /> the running wire $4,284.58 and when we pay this invoice it takes 12 to 24 weeks to get the wire <br /> transformers. The 13 lights will cost$220.00 per month. Residents will be notified and if they <br /> have any questions or concerns they are to call the Town. A motion was made by Councilman <br /> Clark with a second by Councilman Cook to approve. Motion carried 4-0. <br /> Council President Harris informed everyone he had talked to Amy Miller and the town had <br /> qualified to seek some grant stimulus money because the income survey came in at 53 to 54% <br /> low to moderate income. <br /> Attorney Currens had an invoice for MPO for 05 thru 09 for $15,531.00 which we are not <br /> required to pay. However, when it comes time to get projects he thinks it wise to contribute <br /> some money. This can be paid out of Town Hall Budget line item for miscellaneous town <br /> expenses. A motion was made by Councilman Clark with a second by Councilman Cook to <br /> approve. Motion carried 4-0. <br /> Les Farmer,�Fire Chief, will need to look over a request to relieve a bond for work completed at <br /> the new fire station. A motion was made by Councilman Cook with a second by Councilman. <br /> Clark to have Council President Harris be the signatory. Motion carried 4-0. <br /> Councilman Langley reported a citizen had called him.with water problems and he had him <br /> come before the council. The citizen is Shorty Bain. Mr. Bain said the man next door to him <br /> had an 8 X10 crawl space under his house he had filled in and now the water was leaking into <br /> Mr. Bain's basement. David Moore, Utility Superintendent, saw it four months ago and told. Mr. <br /> Bain the Town wasn't responsible because it was on private property. Council President Harris <br /> said Mr. Bain could seek legal help. Attorney Currens told Mr. Bain the town could not go on to <br /> ground it does not own. This is a civil matter and the town cannot get involved. Councilman <br /> Langley said the sidewalk in front of Mr. Bain's home had gotten raised up and Troy Bryant, <br /> Indiana American Water Co., said he would be willing to help resolve this issue. <br /> Animal Control Officer, Mark Taylor, reported twenty-three (23) calls, nine(9) impounds, and <br /> four(4) returns. <br /> A motion was made by Councilman Clark with a second by Councilman Langley to approve <br /> payment of the claims. Motion carried 4-0. <br /> There being no further business before the council at this time a motion was made by <br /> Councilman Cook with a second by Councilman Langley to adjourn the meeting. <br />
