August 18, 2009 <br /> The Mooresville Town Council met in regular session on Tuesday, August 18, 2009, at 6:30 P. <br /> M. at the.Mooresville Government Center. <br /> Town Council members present: President Mark Harris, Vice President Jeff Cook, John L. <br /> Clark, and `Pony Langley. Ryan.Goodwin was absent. Attorney Tim Currens was present. <br /> i <br /> Linda Hilligoss, Grace Church, gave the invocation. <br /> A motion was made by Councilman. Clark with a second by Councilman Langley to approve <br /> minutes of August 4, 2009 meeting. Motion carried 4-0. <br /> A motion was made by Councilman Clark with a second by Councilman Cook to approve <br /> Ordinance#4, 2009 to rezone property at 11270 North State Road 67 from B-3 to 1-1. Motion <br /> carried 4-0. <br /> Marguerite Fisher appeared before the council to request an alley closing at E. Main Street from <br /> noon to 4 P. M. on September 13th for a block party. They have their own barricades and had the <br /> street closing form signed. Motion was made by Councilman Cook with a second by <br /> Councilman.Cook to approve. Motion carried 4-0. <br /> Doug Henselmeir, Mayfield Insurance, presented the health premium for the year September 1, <br /> 2009 thru September 1, 2010. The deduction per person changed from $35,000 a year to <br /> $40,000 in order to get a lower premium. Chubb Insurance will not be the stop loss carrier; HCC <br /> Ins. will be the stop loss carrier. A motion was made by Councilman Clark with a second by <br /> Councilman Langley to approve the$1,418,145 max out of pocket for the Town which is an <br /> addition of$4,000 over the previous year. Motion carried 4-0. <br /> Stan Butrum appeared before the council with a complaint about the noise and dust from Carter <br /> Lee Lumber Co. He said that Carter Lee just put in small trees but would take five years to grow <br /> big enough to be used as a buffer. They can't sleep at night because of forklifts and product <br /> banging the ground. Attorney Currens sent a letter on July 30th about outside storage had to be <br /> enclosed in a fenced area and they were not to be working outside that fenced area. Forklifts are <br /> excluded from the zoning ordinance. Mr. Butrum said Carter Lee had not been using the water <br /> truck like they said they would. Street Superintendent Joe Beikman commented he was trying to <br /> get them to modify their storm water rule 6 to handle dust,but hasn't heard from them. He will <br /> call in the next few days again. <br /> Jeff Allen appeared before the council sayingt was his understanding he was not going to be on <br /> the agenda because he had talked with Attorney Currens and Tim has called DNR to see what <br /> they were going to do. Tim Currens walked the area today to see the problems. Rain and water <br /> events have been very out of the ordinary. This is not one same problem but several different <br /> problems. If relief is provided on the front end of the water it presents problems on down. <br /> Sherry Butcher, 1010 Edgewood and surrounding neighbors spoke. This is the second time <br /> Sherry Butcher's house has been flooded. FEMA helped them the first time. Right behind her <br /> house is a creek. They have to go to a hotel or a friend's house to stay. She said the water <br /> comes down County Line and the creek is not wide enough to put the water down the storm <br /> drain. Council President Mark Harris said a lot of the flooding issues are on private property and <br /> this is frustrating to the council. Attorney Currens wants to come to their hoarse and look at the <br /> problems. The Town does not own the easement. IPL has the easement. Mr. Currens wants to <br /> find out if they are wet lands. He will check county records to see who owns, whereto call and <br /> where to go to get something done. <br /> Gary Taft, 960 Edgewood Drive said he had lived there 32 years and no one has cleaned out the <br /> ditch. Insurance won't cover surface water. His carpet and laminate floor gets ruined every year <br /> with the flooding. <br /> Mike Skinner, 974 Edgewood, said there was fiveTeet of water there. This year it got up into his <br /> house. <br />
