ORDINANCE NO. ~, 1983 SPECIAL ORDINANCE REZONING REAL ESTATE IN THE BUFFER ZONE ADJOINING THE CIVIL TOWN OF MOORESVILLE, MORGAN COUNTY, INDIANA WHEREAS, the Mooresville Plan Commission has held a public hearing relative to a petition for rezoning filed by Harry F. TidIer and Delores A. TidIer, Robert Burden and Geraldine Burden, which petition was docketed as Plan Commission Docket No. 4-1983, arid -., (¡ WHEREAS, the Mooresville Plan Commission has recommended to the Board of Trustees of the Civil Town of Mooresville, Indiana, that the petition of .I ./ ./ .- Harry F. TidIer and Delores A. TidIer and Robert Burden and Geraldine Burden be approved to rezone the following described real property from its current classification of GB-Genera1 Business to I-Industrial: Part of the West half of the Southeast quarter of Section 36, Township 14 North, Range 1 East of the Second Principal Meridian, Morgan County, Indiana, bounded and described as fol10ws,to-wit: Beginning at an iron pipe at the Southeast corner of the West half of the West half of the Southeast quarter of Section 36, township and range aforesaid, run thence N 000 00' on and along the East line of the West half of the West half of said southeast quarter a distance of 904,95 feet; thence run S 820 27' 33" W a distance of 572.0 feet; run thence S 010 33' 51" W a distance of 834.43 feet to the South line of said southeast quarter; run thence N 890 35' E a distance of 589.89 feet to the PLACE OF BEGINNING, containing 11.536 acres, more or less, together with a roadway easement for ingress and egress described as follows: Beginning at a point (iron pipe) on the South line of said section 36 and 981.6 feet East of an iron pipe on the East right-of-way line of the Penn-Central Railroad, run thence Northerly on the East line of the West half of the West half of the Southeast quarter of said section 36 a distance of 962.0 feet to property owned by the Town of Mooresville; run thence Westerly a distance of 50.0 feet to a point; thence run Southerly and parallel to the East line of this tract a distance of 962.0 feet to the South line of said section 36; run thence Easterly a distance of 50.0 feet to the place of beginning. WHEREAS, said Board of Trustees of the Civil Town of Mooresville, Indiana -- having considered the petition and recommendation of the Mooresvi1le Plan Commission, and having a public hearing on the same NOW ORDERS AND ORDAINS that such real estate is now rezoned from its present classification of GB-General Business to a classification of I-Industrial, such real estate as described in the aforementioned legal description contained herein, bèing the real estate as described in the "Notice of Public Hearing", published prior
