SECTION 9.6 - NOTICES <br /> <br /> During the course of all construction and as a prerequisite to obtaining the <br />certificate of occupancy under this chapter, it shall be the responsibility of the owner of <br />the property to give the building inspector 48 hour notice prior to all required inspections. <br />Failure to give notice to the building inspector for appropriate inspections required to <br />establish that any structure meets the building code shall result in a fine of not less than <br />$25.00 nor more than $250.00 and in the event of more than three violations of this <br />section during the construction process, the building inspector shall void the <br />improvement location permit. Violations shall be enforced through the Mooresvilie <br />Town Court with any appeal to the Morgan Circuit or Superior Court. All court costs and <br />cost of litigation and attorney fees shall be the responsibility of the violating party. <br /> <br />Filing Procedures <br />Section I. <br /> <br />1. Notice Procedure For All Public Hearings. All petitions before the <br />Mooresville Board of Zoning Appeals and Plan Commission shall be filed in <br />triplicate at the Clerk/Treasurers Office at least ten days prior to the date of <br />public hearing at which the petitions are to be heard and must be on file prior <br />to the date any public notices are sent out. <br /> <br />a. Notice of Publication. Legal notice in a newspaper of <br />general circulation in the Town of Mooresville shall be <br />published at least ten (10) days prior to the hearing date and <br />proof of publication shall be made by an affidavit of the <br />publisher attached to a copy of the notice taken from the paper <br />in which it was published. Such affidavit shall include the <br />name of the newspaper and the time of publication. Proof of <br />publication shall be returned to the Plan Commission five days <br />prior to the public meeting. <br /> <br />2. Notice to Adjoining Land Owners: Additional notice shall be given to <br />all adjoining landowners who are within two parcels in depth or six <br />hundred sixty (660) feet from the subject property, whichever is least. <br />Such notification shall be made at least ten (10) days prior to the heating <br />date and be made by certified or registered mail. For purposes of this <br />notice requirement, where any of the adjoining parcels of ground are <br />owned by the petitioner, the subject property shall be deemed to include <br />such adjoining land owned by the petitioner. <br /> <br />For the purpose of determining the names and addresses of the legal <br />adjoining property owners the records in the bound volumes of the most <br />recent tax assessment records as they appear in the offices of the Morgan <br />County Auditor shall be deemed to be the true names and addresses of <br />persons entitled to be notified. <br /> <br />81. <br /> <br /> <br />
