<br />Where 50% or more of the lots in a block are occupied <br />by accessory buildings, the average setbacks of such <br />buildings determines the dimensions of the setbacks for the <br />accessory buildings in that block, provided that if there are <br />not other buildings within one block or 330 feet of the <br />proposed building in either direction, then the standard set- <br />back lines for the district shall apply. <br /> <br />5. Front yard or building setback lines established in <br />subdivisions recorded prior to the ado~tion of this ordinance <br />establish the front yards in such subd~vision, ~rovided that <br />after the adoption of this ordinance, no subdiv~sion shall <br />be platted with buildin~ setback lines less than the required <br />front yard of the distr~ct in which it is located. <br /> <br />6. Any building which is reconstructed upon the same <br />site of a pr~or structure within twelve months from the <br />removal of the prior structure shall not re~uire a variance <br />as to the development standards of this ord~nance regarding <br />setback. <br /> <br />7. Any new structure which meets the setback standards <br />of fifty (50%) percent of the existing structures in the <br />adjoining area, that being one block each side or 500 feet <br />each side of said structure, shall not require a variance of <br />the setback develo~ment standards of this ordinance, <br />excluding the subd~vision control ordinance, as to the <br />setback requirements. <br /> <br />G. Cul De Sac Setbacks <br /> <br />Cul de sac setbacks shall be measured at the arc of the <br />building line so long as the lot width at this distance is a <br />minimum of 65 feet. <br />H. Lot Coverage <br /> <br />All buildings hereafter erected and existing buildings <br />which may be reconstructed altered, moved or enlarged shall <br />not exceed the maximum lot coverage regulations of the <br />district in which they are located. <br /> <br />I. Restrictions Along streams <br /> <br />------------------------------- <br /> <br />1. No permanent structures may be erected and, if <br />erected in violation of this section, no such structures may <br />be used if the location is within 75 feet of the center line <br />of any legal tile ditch, or within 75 feet of the existing <br />top edge of any legal open ditch as determined by the Morgan <br />County Drainage Board. <br /> <br />2. No authorization of a use, under this ordinance, <br />includes the authority to dischar~e liquid or solid wastes <br />into public waters except as perm~tted under the stream <br />37 <br /> <br />----------------------- <br /> <br />----------------- <br />
