<br />except in conformance with this ordinance. <br /> <br />D. Nothing herein contained shall require any change in the <br />plans, construction or intended use of a building for <br />which the Improvement Location Permit has been legally <br />issued prior to the effective date of this ordinance. <br /> <br />E. In the event that a non-conforming use of any building or <br />property is discontinued for a continuous period of one <br />year, the use of said building or property shall there- <br />after conform to the uses permitted in the district in <br />which it is located. <br /> <br />F. When a building containing a non-conforming use is <br />damaged b¥ fire, explosion, act of God, or other catas- <br />trophic clrcumstances to less than 1 1/2 times its <br />current assessed value, it shall not be restored except <br />in conformity with the regulations of the district within <br />which it is located. <br /> <br />G. These provisions apply in the same manner to a use which <br />may become a non-conforming use due to a later amendment <br />to this ordinance. <br /> <br />H. A change of use must meet all applicable Town ordinances <br />in addltion to the requirements of this ordinance. <br /> <br />SECTION 8.1 - INCOMPATIBILITY OF NONCONFORMING USES <br /> <br />--------------------------------------------------- <br /> <br />Nonconforming uses are declared by this ordinance to be <br />incompatible with permitted uses in the districts in which <br />such use is located. A nonconforming use of a structure, a <br />nonconforming use of land, or a nonconforming use of a <br />structure and land in combination shall not be extended or <br />enlarged after passage of this ordinance by attachment on a <br />buildlng or premises of additional signs intended to be seen <br />from off the premises, or by the addition of other uses of a <br />nature which would be generally prohibited in the district in <br />which such use is located. <br /> <br />SECTION 8.2 - AVOIDANCE OF UNDUE HARDSHIP <br /> <br />----------------------------------------- <br /> <br />To avoid undue hardship, nothing in this ordinance shall <br />be deemed to require a change in the plans, construction, or <br />designated use of any buildlng or development on which actual <br />construction was lawfully begun prior to the effective date <br />of adoption or amendment of this ordinance and upon which <br />actual construction has been carried on diligently. Where <br />demolition or removal of an existing building has been <br />substantially completed preparatory to rebuilding, such <br />demolition or removal shall be deemed to be actual <br />construction, provided that the work shall be carried on <br /> <br />87 <br /> <br />_J <br />
