2O0 Town attorney Tim Currens advised the Council that he would investigate the Town's legal position on this matter. Council President Ballard asked Mr. Gamble to return to the next Council meeting to find out the status on this claim. Motion was made by Councilwoman Overholser, second by Councilman Viles to approve the Mooresville Revitalization Group's request to close East Main Street from Indiana Street to the first north-south alley on Saturday, December 4, 1993 from 11:00 a.m. to 3:00 p.m. Motion carried unanimously. Motion was made by Councilman Edwards, second by Councilman ~ Viles to approve Resolution #2-1993 A Resolution of the Town Council of the Town of Mooresville, Indiana, Approving An Order of the Mooresville Plan Commission Approving a Certain Declaratory Resolution and Economic Development Plan. Adopted by the Town of Mooresville Redevelopment Commission. Motion carried unanimously. Motion was made by Councilman Heald, second by Councilwoman Overholser to approve Ordinance #15-1993 An Ordinance to Rezone Property owned by Virginia S. Butler, located on south State Road 67, from Agriculture to B-3. Motion carried unanimously. Motion was made by Councilman Heald, second by Councilman Edwards to approve the rezoning of the property on State Road 67 South which lies north of Poe's Cafeteria and south of Motorola owned by the McLaughlin's from Agriculture to I-1. Motion carried unanimously. Motion was made by Councilman Viles, second by Councilman Edwards to approve Ordinance #16-1993 An Ordinance to Provide for the Regulation of Basic Service Tier Rates and Related Equipment, Installation and Service Charges of Any Cable Television System Operating in the Town of Mooresville, Indiana; and Ordinance #17-1993 An Ordinance Authorizing the Civil Town of Mooresville To Adopt the Cable Television Rate Regulations as Established by the Federal Communications Commission. Motion carried unanimously. ~ Motion was made by Councilman Viles, second by Councilwoman Overholser to approve the Contract for HNTB to engineer the sewer construction for Sycamore Lane contingent on Tim Currens reviewing the language of the contract in regard to easements. Motion carried unanimously. Fire Chief Darrell Brown advised the Council that the town does not have an adequate number of fire hydrants on South Park Drive due to the fact that there are no existing water lines in that area. The Council advised Chief Brown to negotiate with Hoosier Water and the property owners on South Park Drive to rectify this situation. Economic Development Director Randy Haymaker advised the Council that the town would like to employ H. J. Umbaugh as financial consultants for the Town's portion of the Economic Dvelopment Income Tax. Motion was made by Councilman Heald, second by Councilwoman Overholser to contract H. J. Umbaugh for the financial consultation needed for the EDIT tax. Motion carried unanimously. Economic Development Director Randy Haymaker presented the Council with facts involving the TIF distribution to this point. ~ I Motion was made by Councilman Edwards, second by Councilwoman Overholser to pay the bills and claims. Motion carried unanimously. There being no further business to come before the Mooresville Town Council at this time, motion to adjourn was made by Councilman Heald, a second by Councilman Viles.
