569. <br />October 15, 2002 <br />The Mooresville Town Council met in regular session on Tuesday, October 15, 2002, at <br />6:30 P. M. at the Mooresville Town Hall. <br />Council members present were: President Tom Warthen, Andy Pygman, John L. Clark, <br />Toby Dolen, and Mark Mathis. No members were absent. Town attorney Tim Currens <br />was present. President Tom Warthen gave the prayer. <br />L_ Motion was made by Councilman Clark, second by Councilman Dolen to approve the <br />minutes of the October 1, 2002 meeting. Motion carried 5 -0. <br />President Warthen told the Council and the Public that this was a Public Hearing for an <br />additional appropriation from the General Fund for $8,500.00. This was money received <br />from selling Police Chief Viles car to another entity. The money will be put in the Police <br />budget to help pay for a new car for the Chief. There were no comments. A motion was <br />made by Councilman Clark, second by Councilman Dolen to approve the additional <br />appropriation. Motion carried 5 -0. <br />Next on the agenda was the South Street Alley, signage and or gravel. Councilman <br />Pygman said he still wanted to gravel the alley. Nancy App, a resident, said she saw no <br />reason to gravel the area because this was always grass and the neighbors kept the grassy <br />part mowed. President Warthen said the council had received an initial request to have <br />the homeowners that agree, to fund the gravel, but if gravel was approved, he would <br />rather the Town gravel and maintain the alley. Councilman Mathis said the first request <br />was to put the alley back as it was after the wastewater line work was finished, but the <br />area was never graded, so the second request was to gravel the alley. One of the residents <br />asked if it was possible to pave that alley since all the other alleys in the Town was <br />paved. Nancy App asked if heavy horse trailers would ruin the sanitary lines. Joe <br />Beikman, Street Commissioner, told her that the sanitary lines should be alright, but the <br />storm sewer was not bedded for traffic. She said one neighbor wanted to park a semi in <br />his backyard and the person who had requested work done on the alley was rumored to <br />want to put a horse - shoeing business at his home. President Warthen told the council he <br />had talked to Mrs. App, but not to the other neighbors on South Street. Councilman <br />Mathis said he hadn't talked with the neighbors either. Councilman Dolen said he <br />wanted to have Councilman Mathis and Warthen to talk to the neighbors and bring back a <br />report to council before deciding on a plan. Motion was made by Councilman Pygman to <br />gravel the South Street Alley. No second was forthcoming, so the motion died. Motion <br />was made by Councilman Dolen, second by Councilman Clark to table this item to the <br />second meeting in November. Motion carried 4 -1. Councilman Pygman opposed. <br />Mr. Sladle, on the agenda to request having a go -cart race, did not appear. <br />Councilman Dolen told the council that new laws will go into effect soon and there will <br />be a federal mandate to keep storm drains absolutely clear. He said that people mow <br />grass and blow clippings into the street and he would like an ordinance for all refuse that <br />is blown into the street. President Warthen said the law was Phase 2 Surface Drain Act <br />and was supposed to go into effect in March 2003 and the council will have to pass an <br />ordinance to be in compliance. <br />Councilman Dolen told the council that the street department wanted to purchase another <br />truck because they had to take one of the trucks and keep the mosquito sprayer on it. <br />Street Commissioner Joe Beikman said the state bid had 2003 trucks at a 2002 price, <br />which was around $23,000 with a bedliner. He said he had enough money in his budget <br />he could transfer around to pay for the truck. Motion was made by Councilman Dolen, <br />second by Councilman Pygman to proceed and buy the truck with extended cab and 4 <br />wheel drive. Motion carried 4 -1. President Warthen opposed. <br />
